Mainstream theory presents autism as an epidemic, disease or deficit. But what about the strengths and abilities that can be found within the spectrum?

Autism may represent the last great prejudice we, as a society, must overcome. History is riddled with examples of intolerance directed at the atypical. We can sometime fear that which diverges from the norm, and sometimes that fear leads us to frame those who are different as being in some way lesser beings than ourselves.

Intolerances take generations to overcome. Racism is an obvious, ugly example. Other horrifying examples are easy to find: take, for instance the intolerance faced by the gay community. Countless gay people were diagnosed with sociopathic personality disturbance based upon their natural sexuality. Many were criminalised and forced into institutions, the treatments to which they were subject akin to torture. How many believed they were sociopathic and hated themselves, wishing to be free from the label they had been given? How many wished to be cured so that they could live their lives in peace? The greatest crime was the damage perpetuated by the image projected upon them by those claiming to be professionals.

Eeoc V Goodwill Industries Of New York & New Jersey

An employee with cognitive impairments had difficulties understanding the rules and expectations while participating in a Goodwill Industries janitorial program for individuals with disabilities. When he requested additional training or job coaching to improve his performance, he was instead given written warnings which he was unable to read or understand and was eventually fired. The EEOC sued Goodwill Industries of New York and New Jersey on behalf of the employee after initial attempts to reach a settlement failed. The complaint charged Goodwill Industries of discriminating on the basis of disability by failing to provide a reasonable accommodation that would allow the individual to perform the essential functions of the job without resulting in undue hardship. Such accommodations in this case could have been job coaching, additional training, and/or modifications to the employers standard operating procedures. In addition, the EEOC stated that Goodwill Industries was required to engage in an interactive process to determine if there is a way to accommodate the individual. The case was settled a few months after the court filing and Goodwill agreed to pay $65,000 in back pay to the former employee and institute new procedures in the janitorial program to ensure that others receive the supports that they need to continue their employment.

When the attempt to resolve the issue through pre-litigation settlement failed, the EEOC filed a complaint with the district court of Utah. The case was ultimately settled, and Papa Johns Pizza agreed to pay the employee $125,000, review its equal employment opportunity policies, conduct training for management and human resources employees in restaurants in Utah, and establish a new recruitment program for individuals with disabilities.

The Eeoc Settlements And Court Case Summaries

If an individual with ASD believes their rights under Title I of the ADA have been denied, the first step should be to engage directly with the employer and attempt to resolve the issue. If that effort is not satisfactory, the individual can file a federal complaint. The individual cannot file a Title I complaint initially to the federal courts, but first must file with the EEOC. Generally, the agency will attempt to settle complaints through mediation between the employee and employer. If both parties do not agree to mediate or the issue is not resolved, the EEOC will investigate to determine if there is reasonable cause to believe discrimination has occurred. If so, the agency attempts to resolve the issue with the employer. If that is also unsuccessful, the EEOC may file a court action. If the agency decides not to file a court action, it will issue a right to sue letter which allows the employee 90 days to file a court action.

Cognitive and communicative functioning can be measured through the use of standardized testing that is appropriate for a claimant’s age and special tests for language development or speech pattern development. Regarding the measurement of cognition itself, a primary sign of limited function is a valid IQ score of 70 or less.

Focus is the ability to concentrate on a task, to stick with it, and to maintain a pace at the task that would be considered an age-appropriate level. This is measured both by observing the child and also measured by results obtained from standardized testing.
